As a Transaction Broker, Timeshare Southeast (Yesco Realty, LLC) provides a limited form of representation, which means that neither buyer nor seller is responsible for the acts of the licensee and that both parties agree to give up their right to the undivided loyalty of the licensee.
A Transaction Broker does not own the property, but rather facilitates a real estate transaction by representing both the buyer and seller without bias toward either party.
Our duties as a transaction broker are:
- to provide full disclosure of all known facts that materially affect the value of residential property which may or may not be readily apparent to the buyer.
- to provide limited confidentiality, unless waived in writing by a party in order to prevent disclosure of such information as the fact that:
- the seller will accept a price less than the asking or listed price;
- the buyer will pay a price greater than the price submitted in a written offer;
- a seller or buyer will agree to financing terms other than those offered;
or any other information that a party requests remain confidential.
- to excercise appropriate care and diligence during the transaction.
- to present all offers and counteroffers in a timely manner.
- to account for all funds.
- to deal honestly and fairly with both buyer and seller.
- any additional duties that may be entered into by this or separate written agreement.
Be advised that you should not disclose any information regarding a transaction that you wish to be held in confidence until you have agreed to engage a real estate licensee in an authorized brokerage relationship. You should not assume that any real estate broker or salesperson represents you otherwise, either as a single agent or as a transaction broker.
